These Terms of Service ("Terms") govern your use of Simple Gym Tracker ("the App", "we", "us", or "our"), including the iOS app, Android app, and this website. By downloading, accessing, or using the App or website, you agree to these Terms.

Fitness and Health Disclaimer

Simple Gym Tracker is a workout logging and planning tool. It does not provide medical advice, diagnosis, treatment, personal training services, or emergency services. You are responsible for deciding whether an exercise, workout plan, or fitness activity is appropriate for you.

Consult a qualified healthcare professional before starting or changing an exercise program, especially if you have a medical condition, injury, or concern. Stop exercising and seek medical attention if you feel pain, dizziness, shortness of breath, or any other concerning symptoms.

Your Data and Responsibilities

The App is designed to store your workout and fitness data locally on your device. You are responsible for maintaining your device, backups, exported files, and any information you enter into the App. We are not responsible for data loss caused by device failure, deletion, operating-system changes, backup settings, or actions outside our control.

Acceptable Use

You agree not to misuse the App or website. This includes agreeing not to:

• Use the App or website for unlawful, harmful, or abusive purposes
• Attempt to interfere with, reverse engineer, or disrupt the App or website
• Submit false, misleading, unlawful, or infringing content through the website
• Use the App in a way that could harm yourself or others

App Stores and Purchases

If you download the App from the Apple App Store, Google Play, or another app marketplace, your download and any purchases may also be governed by that store's terms, policies, and payment rules. If the App offers paid features, subscriptions, or in-app purchases, billing, refunds, cancellation, and purchase management are handled by the applicable app store unless otherwise stated.

Intellectual Property

The App, website, branding, design, text, graphics, and software are owned by us or our licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of the App or website to you. You may use the App for your personal, non-commercial fitness tracking.

Third-Party Services

The App or website may link to or interact with third-party services, such as app stores, device backup services, email, file sharing, or analytics providers. We are not responsible for third-party services, and their own terms and privacy policies apply to your use of them.

Disclaimers

The App and website are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the App or website will be uninterrupted, error-free, or compatible with every device, operating system, or fitness routine.

Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from your use of or inability to use the App or website.

We may update the App, website, or these Terms from time to time. If we make changes to these Terms, we will update this page and revise the "Last updated" date. Your continued use of the App or website after changes become effective means you accept the updated Terms.
